MEMBERSHIP

I agree to the following contract terms for the Membership. I will be billed $99 a month on my account that I have provided. This contract is month to month and auto renewing. I will notify Portsmouth Athletic Club of my intent to cancel at least 30 days prior to my next billing date.

Terms of Agreement:

The term of this agreement is Month to Month. This agreement authorizes Portsmouth Athletic Club to bill the above member’s account on an ongoing basis on the 1st of every month. All automatic billing memberships are ongoing. The membership is automatically renewed on a month to month basis until the member terminates the membership. The member will be obligated to pay monthly dues, regardless of club usage. Lack of use does not indicate a termination of membership. The member may terminate his or her membership by notifying Portsmouth Athletic Club in writing 30 days prior to the billing date desired for termination.

EFT Transactions returned to Portsmouth Athletic Club without payment will result in fees of $10 per transaction.

Membership Termination (or Cancellation) Policy:

Members may terminate their membership obligation at any time, without reason, with 30 day's notice from the 1st of the month. Without 30 day's notice, member will be subject to one more billing cycle. No refunds will be paid. In order to terminate, please call, write, or come in person to the front desk.

Annual Maintenance Fee:

Each year, each member enrolled on a monthly membership will be required to pay a $39.00 annual fee. Proceeds of this fee go toward operating expenses. This fee will be electronically billed to all EFT paying members on either April 1 or October 1. 

Membership Suspension (also known as a Freeze or Hold):

A member may suspend his or her membership for a period of up to three months in a one-year period for a ten dollar ($10) monthly fee instead of his dues for each month frozen. Medical or military suspensions may exceed three months with appropriate documentation. Maximum suspension is one year.

House Charge Authorization:

By signing this agreement, I am also agreeing to authorize Portsmouth Athletic Club to accept house charges for myself and any other members billed to my account. I understand that these charges will be collected electronically along with my monthly dues amount if applicable. Any fees uncollected will be subject to the service fee.

Use of Club Facilities:

Club management may from time to time change the rules governing the operations of the Club, schedules of activities and hours open. Unauthorized use of facilities may result in membership suspension or termination. Club management may suspend or cancel the rights, privileges or memberships of any member whose actions are detrimental to the enjoyment of the Club by other members, or for failure to comply with Club rules.

Equipment and Services:

The Club is equipped with exercise machines, free weights, cardiovascular training equipment and various amenities. Certain services may require additional charges such as guests, towels, childcare, personal training, etc. Management reserves the right to make reasonable changes in equipment, facilities and services.

Release and Waiver of Liability:

The member acknowledges and accepts the risks inherent in the use of Portsmouth Athletic Club services and facilities. By use of the SSC facilities and services, the member hereby voluntarily assumes the risks of injury, accident, death, loss, cost, or damage to his or her person or property which might arise from the use of Portsmouth Athletic Club services or facilities. The member, his or her executors, representatives, or assigns, hereby releases Portsmouth Athletic Club from all claims or liabilities for personal injury or property damage of any kind sustained by the member while on the premises of Portsmouth Athletic Club except for injuries or damage directly caused by the willful misconduct of the officers, employees, or agents of Portsmouth Athletic Club. Member further certifies that he or she is in good physical health and able to undertake and engage in the physical exercise or sports activities in which he or she chooses to participate.

358-I:6 Buyers Rights:

(I) Every seller of a prepaid health club services contract shall: (a) Refund to the buyer the pro rata cost of any unused services, within 15 days after request therefor, if: (1) The buyer is unable to receive benefits from the seller’s services by any reason of death or disability. The health club may require that the disability be confirmed by an examination of a physician agreeable to the member and the health club; provided, however, that this subparagraph shall not operate to prevent the buyer from providing the disability judicial proceeding; or (2) The seller relocates his family more than 8 miles from its present location, or the services provided by the seller are materially impaired (b) Refund to the buyer the pro rata cost of any unused services under all contracts between the parties, within 15 days after request therefor, if the aggregate price of all contracts in force between the parties exceeds $1,000. Provided, however, if the contract so provides, the seller may retain a termination fee of not more than 25 percent of the pro rata cost of unused services on all contracts, not to exceed $250. (c) Refund to the buyer the pro rata cost of any unused services within 15 days after the club ceases operation. (d) Upon the occurrence of any of the circumstances enumerated in the subparagraphs (I) (a) (b) or (c) of this section, the buyer or his estate shall be relieved of any further obligation for payment under the contract not then due and owing. (II) Upon the occurrence of any of the circumstances in subparagraphs (I) (a) (b) or (c) of this section, the buyer or his estate shall be relieved of any further obligation for payment under the contract not then due and owing.

NOTICE TO BUYERS: DO NOT SIGN THIS CONTRACT UNTIL YOU HAVE READ ALL OF IT. ALSO, DO NOT SIGN THIS CONTRACT IF IT CONTAINS ANY BLANK SPACES. YOU MAY CANCEL THIS TRANSACTION IN WRITING ANY TIME PRIOR TO MIDNIGHT OF THE THIRD BUSINESS DAY AFTER THE DATE OF THIS TRANSACTION. STATE LAW REQUIRES THAT THIS HEALTH CLUB REGISTER WITH THE BUREAU OF CONSUMER PROTECTION AND ANTITRUST OF THE DEPARTMENT OF JUSTICE AND MAY REQUIRE THAT THIS HEALTH CLUB POST A BOND TO PROTECT CUSTOMERS WHO PAY IN ADVANCE FOR MEMBERSHIP OR SERVICES IN THE EVENT THIS CLUB CLOSES. YOU SHOULD ASK TO SEE EVIDENCE THAT THIS CLUB HAS EITHER POSTED A BOND IN COMPLIANCE WITH THE LAW OR HAS BEEN EXEMPTED FROM THIS REQUIREMENT BY THE ATTORNEY GENERAL BEFORE YOU SIGN THIS CONTRACT. IF THIS CLUB HAS NOT PPOSTED SUCH A BOND, AND YOU PAY THIS HEALTH CLUB FOR MORE THAN ONE MONTH’S MEMBERSHIP OR SERVICES IN ADVANCE, THEN YOU ARE PAYING FOR FUTURE SERVICES, AND MAY BE RISKING THE LOSS OF YOUR MONEY IN THE EVENT THAT THE CLUB CEASES TO CONDUCT BUSINESS.

I understand that I am in full control of my payment, and if at any time I decide to make any changes or discontinue the EFT service, I will visit or write Portsmouth Athletic Club. 

Change of payment method will not affect other provisions and terms of my Agreement.

Portsmouth Athletic Club assumes that all credit card numbers will be renewed with new expiration dates unless notified. 

Any billing change requires 30-day notice to Seacoast Sports Club. 

Our dues are processed by MINDBODY.

We add a $10 service charge to all returned items.

Purchasing a Portsmouth Athletic Club membership implies agreement with these terms.
